Who is concerned?
In the employment of foreign nationals, the Austrian labour market law distinguishes between:
- People who are not covered by the Foreign Labour Act (Ausländerbeschäftigungsgesetz – AuslBG), e.g.:
– Recognised convention refugees (not just asylum seekers)
– Foreign nationals in diplomatic or consular service and their foreign employees
– Teaching and research staff at universities and scientific institutions
– EEA and EU citizens with the exception of citizens of the new member states Bulgaria, Estonia, Latvia, Lithuania, Poland, Rumania, Slovakia, Slovenia, the Czech Republic and Hungary (new EU citizens)
– Swiss citizens (since June 1, 2004)
– Foreign spouses and children of Austrian and EU or EEA citizens with a residence permit
- People whose access to the Austrian labour market is covered by the Foreign Labour Act (AuslBG), i.e.:
Foreign nationals who do not fit into the above categories and who want to take on a job in Austria. A foreign national is a person who does not have Austrian nationality. Employment is defined as being in an employment relationship, in an employee-type relationship or in training.

The legal basis for the admission of foreign workers to the Austrian labour market is the Foreign Labour Act (Ausländerbeschäftigungsgesetz – AuslBG) which is executed by the Public Employment Service.
This regulatory instrument has the aim of ensuring a balanced relationship between supply and demand on the Austrian labour market.
